1. Disclaimer

The materials provided in the coaching sessions are provided 'as is'. The Breathing Diabetic LLC makes no warranties, expressed or implied, and hereby disclaims and negates all other warranties, including without limitation, implied warranties or conditions of merchantability, fitness for a particular purpose, or non-infringement of intellectual property or other violation of rights. Further, The Breathing Diabetic LLC does not warrant or make any representations concerning the accuracy, likely results, or reliability of the use of the materials on its website or otherwise relating to such materials or on any sites linked to this site.

2. Waiver

By accessing the coaching program, you agree to the following:

a. That the coaching offered by is limited to that of instruction of breathing, mindfulness, behavioral science, and related holistic health and wellness practices.

b. That even with clear instruction, there is a possibility of injury, and that it is my responsibility to consult a physician regarding my ability to participate before signing up.

c. I attest that I have no psychological, medical, physical, or emotional condition that would prevent me from safely practicing the exercises offered by The Breathing Diabetic LLC.

d. I release and discharge The Breathing Diabetic LLC from any and all liability, claims, demands or actions that I may have resulting from injury, death, or damages arising from my participation in the coaching, including losses caused by the negligence of the released parties.

e. I recognize that this agreement of release and waiver of liability is a legal contract and that I have complete knowledge of its contents.

3. Limitations

In no event shall The Breathing Diabetic LLC be liable for any damages (including, without limitation, damages for loss of data or profit, or due to business interruption) arising out of the use or inability to use the materials and coaching provided, even if The Breathing Diabetic LLC has been notified orally or in writing of the possibility of such damage. Because some jurisdictions do not allow limitations on implied warranties, or limitations of liability for consequential or incidental damages, these limitations may not apply to you.
